As stipulated in the settlement, Walmart will pay $5.5 million in civil penalties, in addition to $139,908 intended to cover the costs accrued during investigations conducted by the state’s weights and measures departments. Notably, Santa Clara County will receive $1.375 million from this settlement, which is earmarked for the district attorney’s consumer protection fund.

To prevent future incidents, Walmart has also agreed to establish measures ensuring that employees accurately weigh and price products within all of their California stores. The retailer currently operates 280 locations across the state, with 10 stores situated in Santa Clara County.

This settlement is not Walmart’s first confrontation regarding pricing discrepancies. In 2012, the company agreed to a $2.1 million payout for failing to meet compliance standards related to a previous judgment addressing similar pricing errors. Moreover, several Walmart locations in North Carolina faced fines in 2021 and 2022 due to “price-scanner errors” that resulted in customers being overcharged.

Further complications arose for Walmart when, in June 2024, the company settled with New Jersey regulators for $1.64 million due to violations of inconsistent unit pricing across its stores in that region.

The ongoing scrutiny of Walmart’s pricing practices reflects a broader commitment to consumer protection and ensuring fair transactions for shoppers across California and beyond. Businesses must adhere to strict guidelines to promote transparency and maintain consumer trust.
